COURSE RESERVE SERVICE
The Course Reserve Service makes available copies of assigned reading materials in printed format. Faculty are encouraged to have documents accessible to students. Books and other materials will be made available in the "traditional" print Reserves Collection. Ready access to reserve materials is assured by limited loan periods. InterAmerican faculty may place items on reserve in accordance with established policies and procedures. The Libraries have developed this policy to ensure that materials placed on reserve comply with the provisions of the copyright law of the US (Title 17, US Code).

Location of Reserve Materials
Print reserve and audiovisual materials are located in the Circulation Department of the library.

Availability and Loan Periods

Print and multimedia reserve materials are available when the libraries are open. They have limited loan periods of 2-hours, 24-hours, or 3-days as requested by the instructor. Materials on two-hour loan may not circulate outside the library.
Fines: Overdue fines for Reserve materials accrue at the rate of $0.25 per hour.

Accessing Materials on Reserve
Access to Course Reserve materials is restricted to InterAmerican faculty and currently enrolled students. Users checking out materials will be required to provide a current MDC ID. All materials stored in the Course Reserves Collection are protected under the copyright laws of the United States (Title 17, U.S. Code) governing the use of copyrighted materials. Persons using these materials are liable for any infringement if a copy is "used for any purpose other than private study, scholarship, or research."

PLACING MATERIALS ON RESERVE
Reserve Request Form
Instructors must complete a Course Reserve Form to place materials on Reserve. Forms are available at the Circulation/Reserve Desk. Signed, completed forms should be submitted to the Circulation Department for processing. Requests will be processed in the order of receipt. While requests will be accepted any time the library is open, processing of materials occurs only from Monday through Friday, 8 a.m. to 5 p.m.

Type and Amount of Material
Faculty members may place library books, personal books, copies of articles, course notes, answer sets, and other similar materials on Reserve. The items must represent materials required for a class taught during the current semester. AV materials may also be placed on reserve at the Circulation/Reserve Desk.

Library periodicals
Most Special Collections and Reference materials
Materials owned by another library
Reproductions or formats which are not in compliance with the U.S. Copyright Law (Title 17 of the U.S. Code)

Library-owned Materials
Allow at least three days for retrieving and processing Library-owned materials. To expedite processing time, instructors may retrieve the materials from the stacks. If an item is checked out, it will be recalled immediately. Two or more instructors may request that the same item be placed on reserve for the same semester. The item will be indexed under the name and course(s) of each instructor. However, the item will only circulate for the shortest of the selected loan periods.

Personal Items
Instructors are welcome to place personal books and other materials on reserve. Personal items will be processed and circulated according to standard reserve procedures, including labeling to facilitate check out, and sensitization to deter theft. If the library owns the item, the library's copy will be placed on reserve and the instructor's copy returned, unless specifically requested otherwise. While efforts will be made to safeguard materials, the library is not responsible for any damage to or theft of personal items placed on reserve.

Processing Time
Most materials will be placed on Reserve within three (3) business days. To ensure that materials will be on reserve for the first day of class, instructors should submit requests at least two (2) weeks prior to the beginning of the semester. Instructors should not expect materials to be immediately available upon submission. However, more time may be necessary for:

requests submitted on or after the first day of class
requests with incomplete citations
materials which are currently unavailable
requests not accompanied by the materials
materials which require permission from the copyright holder

COPYRIGHT COMPLIANCE
The Copyright Law of the United States
All materials placed on Reserve are subject to compliance with the Copyright Law of the United States (Title17, US Code).

Only materials that have been reproduced in compliance with Copyright Policy may be placed on reserve:

Permission must be obtained from the copyright owner to reproduce the material for reserve use, including the payment of copyright fees as necessary;

The determination that the fair use falls within the guidelines of the Fair Use provision of Section 107 of the US copyright law. 

Any permission granted, or Fair Use determination made, applies to the reproduction of the material for only one class (represented by one unique course number including all sections) for one semester;

A maximum of 25% of the text of a book or of the items in a publication of essays, poems or articles may be used;

A maximum of 25% of the text of a periodical or two articles from such an issue may be used;

Access to the material subject to the permission must be limited by means of student identification.

Copyright allowance and permission for use of copyrighted materials placed on Reserve expires at the end of each semester. Continued use of the same materials must be in compliance with the Copyright Law for continued use. The Library reserves the right to assess which form of compliance is appropriate for a given reserve item and to reject any materials which are deemed not in compliance with the Copyright Law.

REMOVING ITEMS FROM RESERVE
Materials are removed from reserve at the end of each semester. Instructors may also request removal of items from their course reserve at anytime during the semester. At the end of each semester, all materials on reserve must be removed or renewed for the following semester. Please be aware that renewing materials for consecutive semesters may be prohibited by the Fair Use provision of Section 107 of the U.S. Copyright Law. Toward the end of the semester, instructors will receive a Release/Retain notification via e-mail from the library. The faculty member should indicate whether the materials are to be released or retained for the next term (a list of materials currently on reserve may be obtained from the library). If the instructor does not return a Release/Retain form, the materials will be removed from Reserve. All personal materials will be returned to the instructor.

Items may be retained beyond the current semester when the following criteria are met:
The class is being taught in the upcoming semester and the instructor requests retention;
Retention does not violate copyright law.
